everyone should look at this as drawn up by the BCCI

There was a meeting in Belmopan of the Public Service, Labor and Trade Committee to discuss this today. It would be LUDICROUS for the GOB to pass the amendment as it is written. Enforcing it as written would be impossible. Not that such has prevented measures from getting passed before mind you...

So it's my understanding that this goes to vote at the end of the month... anyone have any info as to if it looks like it will be passed in its current form?

What I remembered reading the new law:

26. When you re-hire someone within 6 months, the 2 periods are considered one.

37. (2) The period of notice shall be:
2 weeks to 6 months employment: One week
6 months to 2 years employment: Two weeks
2 years to 5 years employment: Four weeks.
More than 5 years: Eight weeks

38. (3) Were a worker under a contract of employment for an infinite period fails to give notice he shall be liable to pay to the employer a sum equal to half the wages that would be payable in respect of the period of notice.

41. (2) Dismissal is still the same:
(a) Misconduct (note: this is on or off the job)
(b) Willful disobedience
(c) Lack of skill
(d) Neglect of duties
(e) Absence without permission

46 Sanctions: (2) (c) suspension with half pay not exceeding 30 days

57. 9. (3) and (4) about the 1 1/2 and 2 days pay on holidays does not clarify imo whether the "regular" holiday pay is due on top of the work pay. I was under the impression that they wanted to put a stop to this as it was never intended that way in the law.

183. (1) Severance:
(a) 5 to 10 years: 1 week for each year worked
(b) 10 or more: 2 weeks for each year worked

So if you suspend someone you have to give them half pay? Seems ridiculous. I'm constantly being asked by employees to be sent home with pay. Sounds like an incentive not a punishment.

As I understand it now this law is ambiguous and has been misinterpreted for years. The government will clarify the law by statutory instrument. So holidays will be paid 1 1/2 or 2 days only and not 1 1/2 or 2 +1 day.
