Minister Heredia requested Corporal Young's transfer and offers no apologies; PUP and NTUCB condemn Heredia's actions

The San Pedro Sun first reported on November 29th about an incident in which 43 year old nurse Lisa Marie Merz, US National of Syracuse New York, was arrested, charged and found guilty for several offences while vacationing on Ambergris Caye. The arresting officer was the Head of the Tourism Police Unite in San Pedro, Corporal Sharmane Young. Following the incident involving the tourist, Young was arbitrary and coincidentally transferred without a reason, believed to have been caused by political interference.

According to San Pedro Police, both the Minister of Tourism Manuel Heredia Jr and the Commissioner of Police David Henderson became involved in the arrest of Merz, eventually securing a police bail the day of her arrest. Since The San Pedro Sun first broke the story, the transfer of Young has the subject of national discussion prompting the Heredia Jr. to speak about the issue. Heredia told the media on Wednesday December 5th that he indeed became involved in the incident and had in fact has requested the transfer of Young months prior to the incident. Heredia said that the reason he became involved after being informed of Merz's arrest was because she has been bringing tourists to the country for over 15 years.

"I went immediately to the station, and the officer that was in charge over [there] said that Cpl. Young is not in office, and she will probably not be in until later in the night, or the next day� I managed to speak with the officer in charge of San Pedro, Mrs. Robinson and I asked Mrs. Robinson about the situation with this tourist. Mrs. Robinson said, 'I heard from Cpl. Young that the tourist was behaving not in a very polite manner. I spoke to the tourist who said, 'Minister, thanks for visiting me firstly, because I don't think any other minister would have done that�" Immediately the lady responded, 'I accept that I was a little upset, but that was because Cpl. Young was using excessive force with me. She wanted to take me. I have surgery on both arms, and my hands cannot bend behind," and she showed me� she said, 'the reason I started to use insulting words is because I couldn't stand the pain that was being done to my arm.' Nonetheless, I told her that what I would try to do is I will speak to Mrs. Robinson ask her if she can grant bail. Bu, Mrs. Robinson was very open to say, 'Minister, I will not wake up my officer to grant bail to this tourist.' I called Aragon (Assistant Commissioner of Police Elodio Aragon) who is in charge at Eastern Division. Aragon immediately called Mrs. Robinson. He said, 'Charge the lady if you will charge her, and then grant her bail.' According to Mrs. Young I wanted the lady released without any charges. That has never been my intention," Heredia said in his defense. In speaking about the allegation that as a result of his intervention that Young is being transferred from the island, Heredia said "And I will be - I will - no apologies, right. That indeed for a few months before that, I had asked Mr. Aragon - I think - the Commissioner, if they transfer this officer elsewhere because she was not performing in the best possible manner that is supposed to - when she arrived on the island, she was the best of the best, I believed, that we have had at a person in charge of the Tourism Police. But after that, I personally saw that she was not performing to the best."

And while Heredia was clear with his position, so is the People's United Party (PUP), who fired out a press release condemning Minister Heredia's action and asking for him to step down as the Minister of Tourism. "The People's United Party (PUP) strongly condemns the gross insensitivity, negligence and abuse being shown towards women and children as displayed in two instances that have come to national attention in recent days," said a PUP press release dated Thursday December 6th. [The first instance was in regards to the deaths of newborns at the Northern Regional Hospital.] The release adds that "The second is the matter of Police Corporal Sharmane Young serving at San Pedro, Ambergris Caye, who has been suddenly and arbitrarily transferred primarily due to the arrest of a Tourist. The Corporal was carrying out her duties as the Tourist involved in the incident was found guilty of assaulting her by a court of law. The PUP decries the political meddling and high handedness of a government Minister in Police work�In the case of Corporal Young, this officer has commitments and family responsibilities�The PUP consider these cases to be violence against women and children at the hands of Government and the relevant Ministers. This kind of political interference in the work of the Police must stop." Echoing the sentiment of her party, female parliamentarian Dolores Balderamos Garcia added that "We believe that due process was not followed� this is a woman and has responsibilities, has children and has a family. It is not correct." Meanwhile PUP Chairman for Belize Rural South Milo Paz added that "The San Pedro PUP further demand that Hon Manuel Heredia resigns from his post as Minister of Tourism and that Corporal Young not to be transferred for doing her job and Officer in Charge for the San Pedro Branch be given an apology from Manuel Heredia for doing her job."

The incident with Young and Minister Heredia involvement has captured national attention with callers into the national talk shows calling on the Prime Minister of Belize, Hon Dean Barrow to make a formal statement regarding the actions of one of senior Cabinet minister. The PUP committee in San Pedro also wrote to PM Barrow, asking for Young to be reinstated to San Pedro Town and to reprimand Heredia Jr., recommending that he steps down as Tourism Minister.

Also adding to the public pressure is the National Trade Union Congress of Belize (NTUCB) who issued a press release in which they condemn the "purported involvement" of Heredia in the transfer of Young. "The NTUCB wishes to condemn in the strongest terms possible this type of action; since we perceive it as a political interference, inhibiting the legitimate work of our trained law enforcement personnel. We wish to sound the warning that this type of political misstep will not be tolerated," outlined the press release. It goes to say that " The NTUCB asks that the Government of Belize moves swiftly to address this matter; if only to diffuse the mounting tide of public disdain and to further dispel the notion that; misuse/abuse of political power, is the modus operandi of duly elected government officials. Furthermore, the congress submits that this transfer should be immediately rescinded and that the Minister of Tourism offers to the Belizean populace a public statement on this matter.

But the NTUCB press release says that four other officers stand the same fate of Young. "Finally, we have received word that at least four other police officers are in a similar situation and about to experience fates in similar fashion as that meted out to the San Pedro officer because of political interference from elected officials. Let it be known that the NTUCB will not condone this sort of practice and stand ready to disclose further details if these cases are not addressed.

The Congress firmly believes that the Police Department and its serving officers should be able to operate in a climate free of fear or favour, not to mention political interference - practices that we strongly contend; will only contribute to the deterioration of our social fabric/conscience and most definitely do nothing to stem the crime wave gripping the nation."

Speaking to The San Pedro Sun on Friday November 7th Minister Heredia Jr. explained that his position remains the same and will not respond to both releases. According to Minister Heredia, he will not be dragged into a 'back and forth' since he wants to maintain a level of respect towards Young and would not want to be the person to outline corruption accusations against her. Minister Heredia added that he will leave the comments to the top brass of the Police Department if they so desire to address the concerns outlined by the PUP and the NTUCB.

ACP Aragon Explains San Pedro Transfers

Arragon also spoke about the recent dust up in San Pedro where the officer in charge of the Tourism Police Unit on San Pedro Corporal Sharmane Young was transferred after the area representative and minister of tourism Manuel Herredia complained about her. Young had arrested an unruly tourist Lisa Marie Merz.

But, she's not the only one being transferred. ASP Viennie Robinson who is the officer in Charge at San Pedro is also being transferred. She has bucked heads with the Commissioner a number of times.

Today Arragon explained her transfer wa sin process for some time:

"When it comes to Ms. Vianney Robinson, the officer commanding San Pedro. She has been stated for transfer and I think presently that is being looked at for January. If I am not mistaken it is for the 15th January of next year for her to be transfer to Belize City and at that point in time a replacement will be sent out to San Pedro. That has been in the plan already."

"In regards to Cpl. Young, I would like to tell you that Cpl. Young transfer is an administrative transfer and that transfer was made from police headquarters. Like I mention it would be best to address your question to police headquarters whom are responsible for the transfer of Cpl. Young and I am quite sure they will have reasons as to why they transferred her."

"If we can't get an answer from the 4th or 5th in command in the department - Officer Commanding Eastern Division - there is no answer to be had. Mr. Henderson doesn't take our calls."

"As I have said; as OCED, my powers of transfer lies within reposting within the districts - that does not take away from police headquarters their power of transfer likewise. They may have received reports that I may have not seen as OCED."

Aragon also explained how he interceded to get Lisa Marie Merz bail after Herredia called him.

Aragon says there was nothing irregular about that:

"One of the concerns was when I looked at the situation it was the holiday of the 19th - it was a long weekend. Looking at that situation there I have spoken to officer commanding and I mention to her will this person be charge? What would be the situation with her? If she is to spend all that weekend there for these minor offences and she mentioned to me that that is the present situation they are looking at and I told her listen, this person si somebody well-known in San Pedro - is the police department - why did we take up a responsibility to have somebody detained who may be alleging at this point in time injuries etc. Let us look at assisting in giving her bail, so we do not have somebody up to Tuesday morning detained for these offences. I had ensured that we get appropriate persons who are Belizeans to sign bail and this is all within the legal power of the police. "

According to the San Pedro Sun Merz pleaded guilty to four charges, and not guilty to the charge of "assaulting a uniformed police officer" which she was later found guilty of. Her charges are: Assaulting a uniformed police officer fined $800; Use of Indecent Words fined $100; Use of Insulting Words fined $100; Boisterous Behavior fined $50 and Resisting Arrest fined $300.

2 San Pedro transfers including Officer in Charge

The sudden transfer of Sharmane Young, the Officer formerly in charge of the San Pedro Police Tourism unit, following her arrest of an unruly U.S. National Liza Mertz, had evoked criticism from the National Trade Union Congress of Belize (N.T.U.C.B.). The N.T.U.C.B. chastised Manuel Heredia, the Minister of Tourism, for his involvement in the situation, while asking for Young to be returned to the island. Today, it was also brought to light at the police press conference that the Officer Commanding the San Pedro Police Formation, Assistant Superintendent Vienne Robinson, will also be transferred in the New Year.

"Yes Minister Heredia had spoken to me. He made a call to me and expressed that he would love us to see if we could look into the situation of a specific tourist who was detained. I told him I would look into it the matter. I spoke to the Officer Commanding San Pedro and I looked into the issue. And the issue was plain. A tourist had committed herself; she was under the influence, I got to understand, and as a result the woman corporal had to place her under arrest and escorted her to the station. One of the concerns was when I looked at the situation, it was I think the holiday of the nineteenth-it was a long weekend. Looking at that situation there, I spoke to officer commanding and I asked her, will this person be charged; what will be the situation with her. If she is to spend all that weekend there for these minor offences and she mentioned to me that that is the present situation they are looking at. And that was what was said and that was what was done. Now when it comes to the issue of Corporal Young being transferred from San Pedro and Miss Viennie from San Pedro, I will tell you this; when it comes to Miss Viennie Robinson, she has been slated for transfer and I think presently that is being looked at for January. If I am not mistaken it is for the fifteenth of January of next year for her to be transferred to Belize City and at that point in time, a replacement will be sent to San Pedro. And that had been planned already. In regards to Corporal Young, I would like to tell you that Corporal Young's transfer is an administrative transfer and that transfer was made from police headquarters. And I think if you have any questions, I think it would be best for you to address that to police headquarters. When it comes to police transfers, I would like to mention that there is always a procedure-a process that we follow as a police department and there are always times or exigencies in the job when persons are required to be transferred immediately while others will be factored in within the rotational time for transfer for police officers. Like I mentioned, it will be best to address your questions to police headquarters who were responsible for the transfer of Corporal Young and I am quite sure that they will have reasons as to why they transferred her."

Corporal Young was instructed to report to work in Belize City in mid December.�

I think she plead guilty to all charges except for assault on the officer. Not sure if this is accurate though.

WHAT HAPPENED TO THE 2 SAN PEDRO COPS THAT ROBBED THE DRUNK OF HIS SHOES AND WALLET WHICH WAS CAUGHT ON CCTV

Has this been forgotten ??? I presume they are still on duty maybe the Minister should be following up on that instead of making a fuss over an officer doing her Job.

They're probably still on duty... and working after hours as 'security' for some questionable bars. Strange that the good police officers are accused of not doing their jobs properly, when they obviously are and are well thought of by the community.
