Don't know why but that Twinkie remark reminded me of a case a long time ago. Fortunately it was not in front of me. A guy was charged with cheating on his taxes. His attorney happened to be the head of the Republican Party for the city.
His defense was:
"I did it because everyone does it" Everyone sat there in disbelief, even the Prosecutor. Then everyone laughed, including the Judge.
I guess because of the stroke, for the life of me I can't remember how it ended... but for some reason I think he was discharged.
